in california are awaiting the supreme court decision that could come today. annanne makovec is in san francisco and she joins us with more. >> reporter: even by not making a decision, the supreme court is essentially making a decision ask a lot of people here and waiting to find out what's going to happen today. the u.s. supreme court is scheduled to review whether or not it will review the constitutionality of prop 8. that is the ban on same sex marriage. the pro prop 8 side is appealing, the 9th u.s. circuit court of appeals which found the ban unconstitutional. it's one of several cases across the country concerning the federal defensive marriage act. >> the court has been waiting to gather all 10 of cases together and they're going to make a decision, either grant a review in some of them, all of them, none of them. they could do anything. >> reporter: if they decide not to review the case, same sex weddings could resume as soon as the 9th circuit says osteo. says -- so. we don't know how long that is going to take. they have no deadline for acting on these cases but this is their last conf

this morning, two big quakes rattled the southern california coast overnight. both struck at 2:36 this morning. they were seconds apart. 6 pontd 4 and 6.1 but they have downgraded them to 6.3 and 4.7. they were centered at least 88 miles southwest of catalina island. there is was no tsunami warning issued and people were shaken out of bed but so far no reports of damage or injury. >> students returning to two cupertino schools after a bomb scare skair will notice extra security. terry? >> additional sheriff's deputies will be here at montevista as well as lincoln elementary. two schools shut down all day yesterday as a result of a bomb scare that came from four and a half miles away all the way over in san jose. take a look at the graffiti. this is from linbrook high school. it talked about a bomb and specific teacher at montevista. that threat led sheriff's deputies to shut down montevista and lincoln elementary. there was room by room search and they all turned up nothing, just a hoax but no one was laughing. >> when they go over the edge, columbine -- we've had several, it's not a prank. th

his car into this lincoln just after 11:00. a california patrol spokesman tells abc 7 news that a traffic stop at 90th and bankroft took a dramatic turn when the driver of the bmw sped away. the officers found whit it crashed into the lincoln town car. police say five people in this car never saw the bmw coming and had no time to get out of the way. one person, a woman in her 20s, a passenger was killed. two others taken to the hospital, both with major injuries. the other two passengers in the lincoln treated at the scene. police are not identifying any people in the lincoln town car yet. they're looking for a second person who got out of the bmw after it crashed and ran away. nick smith, abc 7 news. >> it was a violent start to the day in oakland. two men shot to death around 1:00 in the morning in west oakland. less than two hours later a woman stabbed and killed miles away oniyip walnut street. those two incidents are not police identified two young men killed as darrell armstrong and a 19-year-old keith davis. police do not have motive for the killing. there have been

moisture inflow across northern california, plus these high winds creating a very messy situation. these high winds could be knocking down tree branches, knocking out power to many residents across this area, but not just that. the flashflooding potential. all this moisture pushing onshore is going to be bringing about 200 to 300 millimeters throughout the weekend. so there in northern california you're going to be seeing that very high risk. that is the very high elevations in the rockies, snowfall up to about 30, even 60 centimeters of snow in some of these higher areas. if you have plans on traveling across the area, any flights, do they can in on them ahead of time because this is going to be messy and potentially dangerous. talking about the snow, look at spain. cold air spilling across the north. in spain, that cold air mixed with a little bit of precipitation is ending up looking like this. i want to show you a video actually coming out of this area where the snowfall has been coming down and winter has reached spain as temperatures continue to plunge. the country has issue

killing one of the persons inside that vehicle and then tried to run from the copping. california highway patrol tells us this started as a regular pull over. as a stop for speeding. the driver had been spotted speeding but the chp had the car pulled over at 90th. the officers got back into their patrol car and began following the bmw. they lost sight of that car momentarily. when they came over the hill here they came upon this deadly crash. the entire incident took place in a minute or so. the bmwt-boned the lincoln killing one woman inside. >> the bmw collided into a black lincoln. the driver of the bmw jumped z out of the car and began running along with its passenger. >> reporter: they eventualize caught that driver and were able to make a good id because they got a good look at him after they pulled over that bmw. at this point there is no signs of that passenger. i talked to chp earlier this morning. they are interviewing that driver to find out who that passenger was. trying to find out why they ran. right now there is no indication of why they ran. that is still under investigati
